Right to Approach Consumer Court

Any consumer can file a complaint in the Consumer Commission without a lawyer and with minimal fees.

🗣️ What this means for you

You can file a complaint in a Consumer Court (now called Consumer Disputes Redressal Commission) against any seller, manufacturer, or service provider. You do not need a lawyer — you can argue your own case. The filing fee is very low (free for claims up to ₹5 lakh). Complaints can now be filed online through the e-Daakhil portal.

Step-by-Step Action Plan

Gather all evidence — bills, receipts, product photos, communication with the seller.

Determine the appropriate forum: District Commission (up to ₹1 crore), State Commission (₹1-10 crore), or National Commission (above ₹10 crore).

File your complaint online at e-daakhil.nic.in or in person at the nearest Consumer Commission.

Pay the prescribed fee (NIL for claims up to ₹5 lakh, ₹200 for ₹5 lakh-₹10 lakh, and so on).

Attend hearings — you can represent yourself or appoint an advocate.

The Commission must decide the case within 3 months (5 months if testing is needed).

Consumer Protection Act, 2019 (2019)

Section 34 and Section 35

"The District Commission shall have jurisdiction to entertain complaints where the value of goods or services paid as consideration does not exceed one crore rupees. A complaint can be filed by the consumer, any recognized consumer association, or the Central/State Government."

⚠️ Punishment / Penalty

The Consumer Commission can order refund, replacement, compensation, removal of defect, discontinuation of unfair trade practice, or grant punitive damages. Non-compliance with Consumer Commission orders can lead to imprisonment of 1-3 years or fine of ₹25,000-₹1 lakh or both.
